Terms of service
1. Seller and scope
Your contracting party for purchases at retourenscout.com is Retourenscout GmbH, Robert-Bosch-Straße 29, 14641 Nauen, Germany, represented by managing director Tran Thanh Pham. Email: kunde@retourenscout.com; telephone: +49 157 50112992. Commercial register: Amtsgericht Potsdam, HRB 39145 P.
These terms apply to contracts for the sale of goods between us and consumers. A consumer is a natural person entering into a legal transaction for purposes predominantly outside their trade, business or independent professional activity.
The separate dealer area is intended for businesses. A dealer enquiry or availability request through a contact form does not, by itself, create a purchase contract.
2. Offers and orders
The presentation of products in the shop is an invitation to place an order. You can add products to the cart, review and correct your entries before completion, and cancel the ordering process before making a binding commitment.
By pressing the button at the end of checkout that clearly indicates an obligation to pay, you submit a binding offer to purchase. You will receive an electronic acknowledgement of receipt of the order.
The purchase contract is concluded when we expressly accept your order, request payment or dispatch the goods. A message expressly identified only as an acknowledgement of receipt does not, by itself, constitute acceptance. For payment methods where we request payment during checkout, the contract is concluded upon that payment request.
The contract language is German. Before placing your order, you can save or print these terms and the order summary using your browser. Order information will be sent to you by email. A customer account is not mandatory to place an order.
3. Conditions, included items and product information
We offer new goods, including overstock and clearance stock, as well as used and defective goods. Our condition grades are:
G0 – New
G1 – Very good
G2 – Good
G3 – Heavily used
G4 – Defective
When ordering, pay attention to the individual item description, selected Grade and stated included items. A Grade does not replace a description of a specific defect or functional limitation.
Where required by law, deviations from the objective requirements for goods are specifically disclosed before ordering and expressly and separately agreed. These general terms alone do not constitute such an agreement or a blanket exclusion of rights in respect of defects for used or defective goods.
4. Prices and payment
The selling prices displayed in the shop are final prices including any applicable VAT. Any additional shipping costs are shown before the order is placed with binding effect.
Payment methods available for your order are shown at checkout. For bank transfers, pay the amount according to the payment request; dispatch follows receipt of payment. Other payment methods are subject to the payment information shown at checkout.
The delivered goods remain our property until payment has been made in full.
5. Delivery
We deliver to the address provided at checkout in the delivery countries offered for the relevant items. Shipping costs and delivery times are stated in the relevant offer and our shipping information:
https://retourenscout.com/en/policies/shipping-policy
For orders with several shipping groups, particularly standard items and bulky goods, their shipping costs may be added together. The full amount is shown before order completion. Later partial deliveries do not result in additional shipping costs that were not previously agreed.
Statutory rights relating to delivery delays, non-delivery or transport damage remain unaffected. The risk of transport is governed by statutory provisions.
6. Availability requests and estimated prices
An availability request for a condition that is currently unavailable is non-binding. It is not an order, a paid reservation or a promise of delivery. An amount labelled “possible price” or “approx.” is an estimate, not a binding future selling price.
After checking, our team may make you a specific offer. No payment obligation arises from the availability request unless you accept that offer. No deposit is required for an availability request.
7. Withdrawal and returns
Consumers have a right of withdrawal where the statutory conditions are met. Details, the return address and the model withdrawal form are set out in our separate withdrawal information:
https://retourenscout.com/en/policies/refund-policy
A timely, unequivocal withdrawal notice does not depend on prior approval from our team. Our internal inspection procedures do not restrict statutory withdrawal rights or rights in respect of defects.
8. Statutory rights in respect of defects and guarantees
Statutory rights in respect of defects apply. These terms do not shorten the statutory limitation periods for defect claims.
Classification as used, discounted or G4 “Defective” does not mean a blanket exclusion of statutory rights in respect of defects. The statutory requirements apply to specifically agreed deviations.
An additional guarantee exists only if expressly described in the relevant offer. In that case, its scope, duration and guarantor are set out in the guarantee statement. A guarantee does not restrict statutory rights in respect of defects.
9. Liability
We are liable in accordance with statutory provisions. These terms contain no blanket exclusion of liability.
10. Trade-in and dealer enquiries
The “Sell” feature currently serves to submit a non-binding trade-in enquiry. It does not yet provide a binding commitment to a purchase price, immediate payout or shipping label. A trade-in requires a separate offer and its acceptance.
Dealers can contact us through the “Wholesale” area. Dealer prices, stock lists, access requirements and contractual terms are agreed separately.
11. Privacy and applicable version
Information on the processing of personal data is available at:
https://retourenscout.com/en/policies/privacy-policy
The version of these terms validly incorporated when the contract is concluded applies to a purchase. Subsequent changes do not apply retroactively to contracts already concluded. Mandatory statutory consumer rights remain unaffected.
12. Consumer dispute resolution
We are not willing to participate in dispute resolution proceedings before a consumer arbitration body.
